			<content:encoded><![CDATA[<p>A report by UK Judge, Justice Rupert Johnson expects the legal outsourcing phenomena to grow. The full report is expected to come out by the end of the year. The report titled, the civil litigation cost review aims to analyse the economic relationship between law firms, their clients and the courts.</p>
<p>The final report also will contain recommendations on how the relationship between courts, law firms and their client can be made more streamlined and cost effective. The initial report highlights two areas of legal support that have a tremendous potential in the outsourcing space, e-discovery and IP.</p>

			<content:encoded><![CDATA[<p><a href="http://www.tcs.com/homepage/Pages/default.aspx" target="_blank">Tata Consultancy Services</a> (TCS), India&#8217;s biggest IT outsourcing company has recorded a growth of 35% in revenues from the Asia Pacific (APAC) market, compared to a 20% annual growth overall for the year ending March 2009.</p>
<p>Nevertheless, the annual growth of 40% which TCS had maintained for the last five years could not be repeated for this fiscal year. This year TCS expects the growth rate to further reduce as other than China and India, the rest of the Asian economies are have recorded negative growth.</p>
<p>For a long time, the growth in the Indian Outsourcing space was due to IT outsourcing, but now business process Outsourcing (BPO) and Knowledge Process Outsourcing (KPO) have also started contributing in the outsourcing space. The IT story remains the bellwether of growth, with future growth expected from legal, education and  HR outsourcing, to name a few.</p>

Before taking an outsourcing decision companies need to look at risk as at a strategic level and then understand how outsourcing can be leveraged, without exposing the company to undue risks. Risk is usually defined as the product of the probability of an event going wrong and the companies exposure to that event.</p>
<p>A <a href="http://www.zurich.co.uk/municipal/newsroom/latest-from-zurich/New+council.htm" target="_blank">recent research</a> by <a href="http://www.zurich.co.uk/municipal/zmhome/welcome.htm" target="_blank">Zurich Municipal</a> has found that general counsels are ill prepared and there is a disparity in current risk understanding and preparedness. There is a growing need to manage risk at a strategic level.</p>

<p>UBS has two captives, one in Hyderabad, India and another in Poland. These centers are together rumored to be valued at around $200 million. About a couple of months back, the analytics unit at Hyderabad was part of a management led buyout. Now the top management and UBS each have a 50% stake in the analytics unit. This unit, know as Verity Knowledge Solutions is not part of this deal.</p>
<p>Sometime back, <a href="http://6ampacific.com/about/">Basab Pradhan</a> had commented as to why outsourcing captives do not work. Basab&#8217;s articles can be found <a href="http://6ampacific.com/2008/05/12/outsourcing-captives-is-not-an-acquisition/" target="_blank">here</a> and <a href="http://6ampacific.com/2007/05/07/the-real-deal-with-offshore-captives/" target="_blank">here</a>. (One was written in May 2007 and another in May 2008)</p>
<p>Basab argues that these captives did not make financial sense in the first place and if Indian companies go ahead and buy these, it does not appear to be a sensible thing for them to do as well.</p>

			<content:encoded><![CDATA[<p>With increased restrictions on the <a href="http://en.wikipedia.org/wiki/H1B_visa" target="_blank">H1-B program</a> in US and in light of <a href="http://dealbook.blogs.nytimes.com/2009/05/05/obama-calls-for-new-curbs-on-offshore-tax-havens/" target="_blank">President Obama&#8217;s comments in Buffalo</a>, the Indian Outsourcing industry is contemplating on shore outsourcing. On shore outsourcing is when an Indian Outsourcing company after bagging a contract, executes a major chunk of contract in the same country, hiring from the local population but from relatively inexpensive locations. For e.g. an Indian Outsourcing company might set up offices in Midwest to execute a contract for a client based in New York.</p>
<p>Indian Outsourcing companies hope to ease up the public opinion directed against them by this measure. In the long run, the Indian outsourcing companies can offer its US clients an option of off shore outsourcing or on shore outsourcing and pass on the incremental cost to the client.</p>
<p>A delegate from Scotland is proposing this for UK markets, in a summit on <a href="http://en.wikipedia.org/wiki/Business_process_outsourcing" target="_blank">BPO</a> organized by <a href="http://www.nasscom.org/">Nasscom</a>, an organization which promotes software companies in India.</p>
